Yes. A Notary Public is a sworn public officer with the power to perform a number of official legal acts. The office of notary public is technically classified as a ministerial office, meaning it does not involve significant legal judgment or judicial-style discretion of the acts being performed. The Village of McFarland has several Notary Publics working in various departments within the McFarland Municipal Center, located at 5915 Milwaukee Street. Citizens can stop by our offices and request this service on a drop-in basis. Office hours are Monday through Friday, 8 am to 4:30 pm.

Properties with commercial buildings and residential buildings containing three or more dwellings units are permitted only with a listed fire pit or fireplace with a spark arrestor.
We have approximately 67 paid-on-call/paid-on-premise members. Additionally we have seven full-time employees including five Advanced EMTs, one Fire Inspector/Public Education Specialist, and one Fire and Emergency Medical Services (EMS) Chief.

Yes, the State of Wisconsin requires new firefighters to attend 60 hours of formal classroom and hands-on training before they can respond to fire emergencies. This training is paid for by the Department.
For Emergency Medical Services, the State of Wisconsin requires new EMTs to attend a minimum of 120 hours of formal classroom and training, and that they go through a licensing process to be able to provide care and run as an EMT. This is also paid for by the department.
In addition, the Department encourages firefighters and EMTs to continue in other State-certified courses and these are also paid for by the Department:
The Department has Fire training every Monday and Emergency Medical Services (EMS) training on the third Thursday of every month throughout the year. All firefighters and Emergency Medical Technicians (EMTs) are trained on how to operate any piece of equipment they may be required to use on a call.
The Department also encourages outside training for more intense instruction on various aspects of firefighting and EMS. We also have strict processes for training members on other things such as driving apparatuses and running as an EMS Crew Chief.

Once the form is filed with the Court, you will be notified by mail of your new court date.
It is necessary that you advise the Court of any address change. If you do not appear because you failed to notify the Court of a change of address, you will be found Guilty.
If you do not reach an agreement at the pretrial conference your case will be scheduled for trial. You have the right to a jury trial only in cases of Operating While Intoxicated. If you do not appear in Court in person, enter a plea by mail, or post money for the deposit, the Judge may issue a warrant for your arrest, suspended your driver’s license for two years, or have your name entered in the Internal Revenue Tax Intercept Program.
You are not required to have an attorney for a Municipal Court matter; the decision is yours. Municipal Courts do not provided public defenders.

If you are found Guilty of a traffic violation you may have demerit points added to your driving record. The Court will report the conviction to the Department of Transportation. They will assess the number of demerit points against your record depending on the charge. If you accumulate 12 points in one year by date of violations, your driver’s license will be suspended or revoked.
If you have a probationary license, demerit points will double on the second and subsequent convictions. To find out how many points you have accumulated, you must contact the Drivers License Bureau by calling 608-266-2353.

Fines/forfeitures are disbursed to the Village, State, and County. No officer or court official profits from any fine or forfeiture.
If your driver’s license has been revoked or suspended you have the right to apply for an occupational driver’s license. To obtain an occupational drivers license you will need to contact the Department of Transportation at 608-264-7447 or visit the Wisconsin Department of Transportation’s Suspended or Revoked Driving Privilege page.
If you wish to reduce your demerit points on your driving record you may attend an approved traffic school, one of which is conducted at Madison Area Technical College (MATC) Madison. This procedure does not apply if your current violation results in revocation or suspension, or if school was ordered in lieu of revocation for Operating Under the Influence. Application for Traffic Safety School can be made at MATC or other state vocational schools by visiting the Wisconsin Department of Transportation’s Traffic Safety Courses page.
You need to mail the form at least ten days before the court date listed on your citation; you do not have to appear on your initial appearance court date.
McFarland Municipal Court uses the Tax Refund Interception Program (TRIP) as a means of collecting fines/forfeitures for violators failing to comply with the order of the Municipal Judge.
TRIP is allowed under Wisconsin Statutes 71.93 and 71.935. These Statutes authorize the Wisconsin Department of Revenue (DOR) to intercept taxpayer refunds, other refundable credits, and lottery prizes for certain state agency and local government debts. State agencies and local governments can participate in TRIP.

In the instance that you feel you were in some way mistreated by an officer, felt that their actions were unreasonable, they were rude to you or that they violated Department policy, you should contact a McFarland Police Supervisor. Not every complaint will rise to the level of a formal complaint, and the supervisor will speak with you to determine the nature, scope, and depth of your complaint. He or she will then direct you to the best course of action based upon the facts of the situation.
Note that a complaint is not valid solely because you received a citation or were arrested and you do not agree with the officer’s decision; these situations need be settled through the court process. The complaint process is intended primarily for situations involving your perception of the officer’s conduct, adherence to department policy, and observance of your constitutional rights as a citizen.
The McFarland Police Department takes valid complaints very seriously and, in situations where such measures are necessary, will conduct an in-depth internal investigation. Because such a complaint against an officer is a very serious matter, you should also be aware that Wisconsin State Statute 946.66 provides for a serious penalty for any individual that files a false complaint regarding the conduct of a police officer. When appropriate, it is advisable to take some time to calm down and thoroughly think through what occurred prior to filing such a complaint.
Requests for copies of police reports, accident reports, or other police records are made directly to the Police Department by filling out a Public Open Records Request Form (PDF), and submitting it to the Department.
Once received, the form is reviewed by a Department Supervisor who is specially trained in Wisconsin Open Records Law. You will be notified by the Department as to if the record can be released, and if so, when it will be available to you. There will typically be a nominal fee assessed for copies of documents.
There are situations in which you may need to have your fingerprints taken such as out-of-country travel, certain licenses and permits, or for various employment situations. The McFarland Police Department will provide this service to residents of the Village for a $10 fee. In very limited circumstances, we may also provide this service to non-residents for a $15 fee.
It is recommended that you contact the Department at 608-838-3151 to make an appointment. Requests for fingerprinting that are made without an appointment will be serviced in accordance with the availability of staff at that particular time.
While instances of police impersonators are rare, unfortunately they do occur. Legitimate police vehicles in Wisconsin typically have both red and blue emergency lights and are equipped with siren apparatus. Most police vehicles will have numerous emergency lights, and it is relatively rare for a police vehicle to have just one or two emergency lights, such as a single dashboard light.
If you have legitimate concern that you are being pulled over by a police impersonator, there are a few things that you can do to stay safe:
It’s important to understand that once an officer has prepared a citation, it cannot be voided. Citations are created by in-car computers that are directly linked to the Department of Transportation, and once created cannot be taken back. It’s important to refrain from becoming argumentative, disorderly or abusive. If you believe that you have been unfairly cited, DO NOT make this argument on the side of the road.
Your best option is to avail yourself of your rights in the courtroom. The court date and time is listed on the citation. You have the option to plead guilty, no contest, or not guilty. You may also speak with the Village Prosecutor prior to rendering a plea. A not guilty plea will result in a subsequent trial. Once the citation is issued, all questions pertaining to court proceedings should be directed to the Village Clerk of Courts at 608-838-3764.
Generally, the Chief of Police will not void a citation; this must be done by the Village Prosecutor. In the instance that your complaint is more so regarding the conduct of an officer, or you believe an officer has in some way violated a Department policy, these would be appropriate situations in which to contact a police supervisor.

The Village conducts full value maintenance. This means that every property has their assessed value reviewed annually and potentially changed based on market conditions. This ensures that the village maintains 100% value each year and stays up on current market conditions. This means every property has their property value looked at annually and adjusted for market conditions.
Not necessarily. There two components that drive your tax bill: your assessed value and how much each taxing jurisdiction imposes. Essentially assessed value tells us how to distribute the taxes. If everyone’s assessed value goes up 3%, and the amount of taxes imposed by each jurisdiction stays the same, everyone’s taxes remain the same.

No. In 2010 the State of Wisconsin set limits on the amounts taxing jurisdictions can impose each year. Currently those limits restrict taxing jurisdictions ability to increases taxes to the percentage of net new construction. This includes new houses and building projects that added completely new value to the Village. There are exceptions to the levy limit that include new debt service, annexations, and a variety of other exceptions. The full list of exceptions can be found in Wisconsin State Statute 66.0602(3).

Yes. The Village’s contracted Assessor, Accurate Appraisal, sends a sales questionnaire to recent sales of residential properties. Additionally for the sale of commercial property, they will send a questionnaire to both the buyer and seller; view an Example Sales Questionnaire Letter (DOC). Yes. Each tax bill includes a section on the additional taxes, and how long the referendum will be on the taxes.
The Village recommends each and every resident review their notice of assessed value every year in the Spring. If you have any questions about your assessment, or want to understand how it was calculated, make an appointment to sit down with the assessor at Open Book. Each year the Village holds two days in which the assessor is available to sit down with you and review your assessment. This is also your informal opportunity to dispute your assessment or review the assessment for errors. The assessor can correct your value at Open Book. Your change of assessment notice will contain information on making an appointment.

Your assessed value is comprised of two parts, land value and improvement value. The land value refers to the value of the land, and the improvement value refers to an improvements or structures on the property such as a house or a shed. So an increase in your improvement value often means market conditions have indicated those improvements, such as your house, are now worth more.

There is a box to check on the remittance section of your tax bill. Check the box, and then write on the tax bill what you are requesting the billing address be.
To change owner information on a property tax bill, please contact the Dane County Register of Deeds directly at 608-266-4141 or visit the Dane County Register of Deeds website for more information. Village staff does not have the authority to change names on tax bills.
The property owner is responsible for payment of property taxes. If you have a mortgage on your property, contact your lender for information on how payment from your escrow account will be handled.
Review the check carefully to determine if it needs to be endorsed. Checks made out to the property owner and the Village must be endorsed by the property owner before the Village can cash them. If the check is made out directly to you the property owner, you should deposit the funds into your back account and issue a check to the Village for the amount owed.
If the check is written to both the property owner and the Village, the check should be mailed to the Village with your remittance slip. After the check has cleared, the Village will issue an overpayment to the property owner at the next Village Board meeting. All refunds are issued to the property owner.

Our meal sites our open to any senior over the age of 60. Home-delivered meals are provided for qualified seniors in the Village of McFarland, Town of Dunn, and Pleasant Springs.
Case management is helping older adults navigate through a maze of information and identify resources to promote wellness. A case manager has an ongoing relationship with the client to monitor their usage of services over an extended period of time and advocate for additional services as needed or indicated.
Outreach services are defined as providing short term or one time information and assistance to seniors about programming, loan closet, or outside resources. This includes the programs offered regarding:

We provide a shopping bus five times a month. Two trips are dedicated to going to the local Pick N’ Save, one trip to the Walmart in Monona, and one trip the destination varies. You may also request an individual shopping trip on a select day once a month.

We coordinate rides for medical appointments under the Retired Senior Volunteer Program (RSVP). Screened volunteers handle rides. Reservations are required 1 week in advance.
Since this is a volunteer-based program, we make every effort to find a driver but cannot guarantee a ride. Rides must be during regular business hours of 8 am to 4:30 pm, and you must register as an RSVP passenger. There are some limitations on rides for ongoing appointments such as infusion and dialysis. Cost is on a donation basis.

Typically, there are anywhere from five to 10 registered sex offenders within the Village proper. There typically are, however additional offenders that reside outside of the Village but may technically have a McFarland ZIP code or address. This would include areas such as the Township of Dunn and the City of Madison on the north side of Siggelkow Road. These numbers change on somewhat of a regular basis.
In the majority of cases, neither the public nor local law enforcement are notified by the state, and offenders are moved into our community without notice. The only time local law enforcement is notified is when the offender is under the supervision of the Department of Probation and Parole, is currently subject to specific restrictions and/or is a high risk offender. Having said that, the McFarland Police Department does take extra measures to be aware of changes.
In the event that we are notified of a high risk offender moving into the Village, a variety of notification techniques may be implemented, including neighborhood specific notifications, community notification meetings and information being posted on our website.
In the event of a low risk offender, such as one who’s crime was committed several years prior and has not re-offended and is no longer under supervision or any kind of restrictions, consistent with the practices of most law enforcement agencies we do not conduct notifications. This would be an offender that we were not notified of by the state and is no longer deemed to be a threat by the state. There have been times that we have gone outside of this guideline due to unique circumstances.
The public is encouraged to visit the Wisconsin Sex Offender Registry website on a regular basis to check for changes in their neighborhood, as they have access to the same information that law enforcement does. Another resource is the National Sex Offender Registry.
The McFarland Police Department conducts regular compliance checks of all listed sex offenders within the Village. Our investigative staff maintains a map within the police department showing locations of each offender and case details.
If an offender is found to be out of compliance, the Department of Corrections is immediately notified. Our officers follow the directions given by their staff, which could range from taking the individual immediately into custody to generating a police report and forwarding it to their office, depending on the severity of the violation. If a crime has committed, we would proceed with an arrest.
In the event that a community notification is warranted, a significant amount of time will be spent creating and distributing offender or meeting information, and conducting the actual meetings. Compliance checks generally take the better part of two eight-hour days, with a minimum of two officers conducting the checks.
In a legal sense, the balance between the public’s need to know and the offender’s expectation of privacy can be difficult. Having said that, our department will always defer precedence to the interests of public safety when making notification decisions, and as allowed within the notification guidelines of the Department of Corrections. Our Department keeps close tabs on the offenders listed in our Village, and is comparatively more assertive in our notification strategy than many other communities.
I encourage residents to not only check the sex offender registry on a regular basis, but also to take some time to review the safety tips, recommendations and general offender facts found on the website. The site offers valuable information regarding co-existence with offenders, and many times dispels misinformation about offenders, community notification and community safety.
A variety of restrictions can be placed upon an offender depending on the crime and their current status.
Any dwelling unit where sleeping accommodations are offered for pay on a short-term rental basis to tourists or transients except bed and breakfast establishments, hotels, or any private boarding or rooming houses, ordinarily conducted as such, that do not accommodate tourists or transients.
All Tourist Rooming Houses (TRH) are required to obtain proper licensing and inspection from Public Health of Madison and Dane County, insurance with specific TRH coverage, and a variety of other occupancy/parking requirements, and a Tourist Rooming House Permit through the Village.

Additionally, every owner of a tourist rooming house shall appoint a local agent to manage the tourist rooming house if the owner resides outside a 30-mile radius from the tourist rooming house or if the owner will be absent while the property is being rented as a tourist rooming house.
Yes. However, if you reside outside a 30-mile radius from the tourist rooming house, or you will be absent while the property is being rented, you must appoint an agent.

No. Village Ordinance 11-352(a) provides no person shall be permitted to own or operate more than one tourist rooming house in the Village nor shall multiple persons residing in the same household be permitted to operate multiple tourist rooming houses. A tourist rooming house owned in the name of a corporation, limited liability company, partnership or similar entity shall be considered owned by the same person as another tourist rooming house for purposes of this subsection if any individual natural person derives any income from the operation of both tourist rooming houses.
The initial application fee for a Tourist Rooming House is $500 (includes all inspections). The renewal application is $100 plus $100 for the fire inspection.
Yes. All property owners within 300 feet of a proposed Tourist Rooming House will be notified at least 10 days in advance of the Public Safety meeting in which the application shall be reviewed.

Yes. Beginning January 1, 2018, the Village approved imposing an 8% room tax on rooms or lodging to transients. For details on the room tax, please contact the Clerk/Treasurer at 608-838-3153.
Individuals interested in volunteering should download and complete the McFarland Volunteer Application Form (PDF) and a Waiver of Liability and Assumption of Risk Form (PDF) and submit them to the Administration Department. You can also complete the Volunteer Application Form online.
Minors must have a parent or guardian sign this form. Some opportunities with the Village of McFarland will require a criminal background check, often for positions of greater responsibility or authority. If an applicant does not qualify for a position they are interested in, we will make every effort to place the volunteer in an appropriate role. Sensitive personal data used for background checks is deleted from our records after the check is complete. Some volunteer programs have limited capacity for participation and positions are filled on a first come, first serve basis.
Individuals, organizations, Village departments, and other entities may request one or more volunteers. These requests may be short or long term. To request one or more volunteers, a Volunteer Request Form (PDF) must be completed and submitted to the Administration Department. The form may be picked up at the Municipal Center or downloaded from McFarland’s website.
The Volunteer Coordinator will receive both volunteer applications and volunteer requests. The Coordinator will make the best match of the volunteer’s skills with those needed to successfully complete the specific task.
The Village of McFarland makes every effort to keep volunteers safe in their activities by providing adequate instruction and safety equipment. Volunteers are encouraged to ask about safety procedures and take precautions. The Village of McFarland does not provide personal insurance for volunteers. Should an individual be injured while volunteering, he or she is responsible for all expenses.
The Village of McFarland’s general liability insurance provides coverage against claims resulting from volunteer activities completed as directed or instructed by Village staff. This applies to claims made by the public where a volunteer was involved. As a Village volunteer, while not insured for injury, you are insured for liability.
Individuals selected as volunteers will be required to sign a Volunteer Waiver Form (PDF). Minors will need to have a parent or guardian’s signature. Some volunteer opportunities will require a criminal background check. If an applicant does not qualify for a position they are interested in, every effort will be made to place the volunteer in an appropriate role. If no opportunity exists which would be a good match for an interested volunteer, the application will be retained on file until such time as an appropriate opportunity presents itself.
